HOW PREPARED ARE WE FOR PERSONAL RESPONSIBILITY FOR OUR BOARDROOM MISTAKES? - FRANK MUGETA NYABUNDEGE

SERENGETI BREWERIES ORDERED TO PAY EX-WORKER 1.4BN/- FOR ILLEGAL TERMINATION

The Commission for Mediation and Arbitration (CMA) has ordered Serengeti Breweries Limited (SBL) to pay its former General Manager, Human Resources, Dr Hectoor Sequeiraa, about 1.4bn/- for illegal termination of his employment.

“On the premises, the Commission is convinced that the respondent (SBL) did not have the valid reason to terminate the complainant (Dr Sequeiraa) from the service,” the CMA Arbitrator Alfred Massay, said in his award.

The arbitrator gave the brewery company 14 days to pay the money, which include 130,680 US dollars, being reminder of 18 months salaries and other terminal benefits, notably subsistence expense from the date of termination to the date of repatriation.

An Indian expatriate, Dr Sequeiraa, was terminated from employment in 2009 on ground that his position would be localised, purportedly on the directives by the Tanzania Investment Centre (TIC) and the SBL that they offered the post to one Diana Malambuigi, a Tanzanian.

KENYA AIRWAYS BLAMES TOURISM SLUMP FOR RECORD LOSSES

One of Africa's largest airlines Kenya Airways has announced its biggest ever annual loss.

It has partly blamed the $290m (£188m) shortfall on a decline in Kenya's tourism sector.

Some countries had issued travel advisories warning about terror threats in certain areas.

Finance Director Alex Mbugua also told investors that the airline has been hit by competition from Gulf carriers, reports the Reuters news agency.

SHELL IS AXING 6,500 STAFF AND SELLING $20 BILLION IN ASSETS TO COMPETE WITH THE OIL PRICE SLUMP

Oil giant Royal Dutch Shell just announced its Q2 results — and though they're better than expected, the firm is taking an axe to costs anyway.

Here's what you need to know:
  • Adjusted earnings have slumped from last year, down 37% to $3.8 billion (£2.44 billion). That's still better than the $3.4 billion analysts expected.
  • Revenue for the first half of the year is down from $220.9 billion (£141.66 billion) in 2014 to $138.1 billion (£88.56 billion) this year.
  • 6,500 jobs will be cut across the board.
  • Capital investment has been cut by a fifth, down $7 billion (£4.49 billion).
  • They're selling $20 billion (£12.83 billion) in assets over 2014-15.
The general message today from Shell is that even though they expect oil prices to bounce back, they're still cutting costs pretty sharply. They're also happy with progress on their takeover of BG, another huge oil firm, which was announced in April this year.

Here's what CEO Ben van Beurden had to say:

INCREASED SMARTPHONE USE BOLSTERS DIGITAL ADVERTS

Tanzanian brands have been urged to embrace and adopt digital advertising to reach their target consumers if a sustained growth of commerce is to be achieved.

On average, the Tanzanian user looks at their smartphone more than 200 times in a day, which consists of time spent checking social media feeds to messaging on WhatsApp and e-mails.

Data from Internet World Stats shows that Tanzania recorded 7,590,794 million internet users as of December 2014 translating to 15.3 per cent Tanzanians being consistently online.

With more Tanzanians using smartphones coupled with the ever reducing data prices and increased speeds, the internet is one medium that no brand should ignore.

Squad Digital Managing Director Mr Manish Sardana says that the Generation Y group, 18 - 34 year olds who make approximately 20 per cent of Tanzania’s total population are inseparable from their smartphones, hence brands should develop communication that is mobile friendly.

"A half century into this independence era, it is long past time to put aside old stereotypes of an Africa forever mired in poverty and conflict. The world must recognise Africa's extraordinary progress."

Mr Obama said Africa needed more trade, and that the United States was stepping up its business ties with the continent.

EAST AFRICA AIR TRANSPORT IN FRESH RE-ORGANISATION AMID EXITS AND ENTRIES BY MAJOR AIRLINES

East Africa’s air travel faces another round of re-organisation as two major airlines end direct flights from the region to key destinations in Europe in October.

In October, British Airways will terminate direct flights between Entebbe, Uganda, and the UK’s main Heathrow airport while Brussels Airlines will stop direct flights from Nairobi to the Belgian capital Brussels.

The exit of British Airways from the Uganda route after 24 years means the airline will now have Nairobi as its hub in the region. British Airways ended direct flights between Heathrow and the Tanzania commercial capital Dar es Salaam in March 2013, also citing lack of commercial viability.

AUSTRALIA HAILS TANZANIA OVER PEACEFUL POWER TRANSITION

President Jakaya Kikwete.
President Jakaya Kikwete’s respect for the Constitution that sees democratic and peaceful political power transfer in the country has been hailed by Australian Premier Tony Abbot.

President Kikwete is set to leave office later this year as the country now prepares for the general elections, which will introduce in a new president, MPs and councillors.

Mr Abbot hinted that democratic transfer of power in many African countries has been problematic; hence making Tanzania’s move unique and creditable.

Tanzania’s fundamental law recognises two-term limit on presidency while legislators and councillors are free to run for their seats as much as they can.

President Kikwete, who is expected home today, was in Australia for a fourday official visit among others, to discuss trade, business and global security.

“I congratulate you for deciding to transfer power peacefully as per your country’s constitution. It is very rare to find this in African continent,” Mr Abbot told President Kikwete, stressing that his country will continue supporting various socio-economic drives in Tanzania.

TANZANIA RESUMES USD 111 MILLION OIL PALM PROJECT IN KISARAWE DISTRICT

Plans for completing the 10,000 hectares oil palm project in Kisarawe District of Tanzania are being resumed in order to achieve the USD 111 million planned investment from local state-run National Development Corporation (NDC) and Singapore-based Nava Bharat Pte. Limited (NBS).

NDC, which owns 20% of the joint venture TB Tanagro Limited signed in 2013 with NBS, is leading the Integrated Oil Palm Project in the Ruvu River Basin near Tanzania’s commercial capital Dar es Salaam and so far 6,000 hectares of the total project area have been secured.

NDC expects to get 7,250 liters or 7.7 metric tons of palm oil annually from each hectare of land farmed, which means a creation of about 10MW of electricity from biomass that will be used to operate the project itself while the remaining will be sold to the national grid.

CMA ORDERS BANK TO PAY FORMER EMPLOYEE 263M/- COMPENSATION

Mr Sioi Solomon.
The Commission for Mediation and Arbitration (CMA) has ordered Stanbic Bank Tanzania Limited to pay its former Head of Legal and Company Secretary, Mr Sioi Solomon, over 263m/- for illegal termination of employment services.

The commission ruled in favour of the employee after granting his complaint against his employer, who dismissed him for allegedly failing to carry out reasonable instruction for his employer and gross negligence.

The CMA gave the bank 14 days to effect the payments, which include 235,872,000/- as compensation for illegal termination of employment, 20m/- as general damages and 7,938,000/- as pension for four years.

It held that following such termination in the banking sector where diligence of the highest degree is required, it would not be easy for the complainant to be trusted and get another employment from other banks on the same capacity at a monthly pay of 9,828,000/-.

The CMA ruled further that the complainant was punished for offences that were not proved and thus the subsequent termination of his employment was not proper and the procedure leading to such disciplinary action were not followed.

It noted that under Rule 9 (1) and (5) of Government Notice Number 42 of 2007 clearly stipulates that reason for termination of employment must be clearly spelt out and of serious nature to justify such termination.
